Proposed Interpretation of Section 4(c)(10)(B) of the Northwest Power Act




The following comments were submitted in response to the open comment period described below.

    BPA has issued a proposed interpretation of section 4(c)(10)(B) of the Northwest Power Act for public review and comment. This section of the Act describes certain spending limitations placed on BPA when funding the Northwest Power and Conservation Council. Section 4(c)(10) of the Act directs BPA to financially support and pay the expenses of the Council consistent within certain funding parameters. This section outlines the funds to be available to the Council on a yearly basis in relation to BPA's firm power forecast. This section also states that the funding amount may be increased by the administrator when the funding limit "will not permit the Council to carry out its functions and responsibilities" under the Northwest Power Act. BPA noted in the WP-07 Draft Record of Decision that BPA would be issuing this proposed interpretation of section 4(c)(10)(B) for public comment.
