PNC-14 Federal Register Notice Publication and the Ex Parte Rule
BPA published a notice in the Federal Register on June 30, 2014 (Federal Register Notice) announcing the commencement of the PNC-14 Rate Case.
Upon publication of the FRN, ex parte began and will continue in effect throughout the duration of the rate case. The ex parte rules prohibit BPA from having discussions about substantive rate case matters outside of formal rate case proceedings. All discussions concerning substantive rate matters must take place in publicly noticed meetings. Please refer to the letter discussing the ex parte rule for additional information.
Release of BPA’s Direct Case
BPA released its Initial Proposal in this rate proceeding on Wednesday July 9, 2014:
The rate case is an administrative proceeding in which BPA follows procedures set out in section 7(i) of the Northwest Power Act. This process will be initiated at a Prehearing Conference that will be held July 9, 2014 at 9:00 am in the BPA Rates Hearing Room, 1201 Lloyd Blvd., Suite 200, Portland, Oregon 97232. An audio-only bridge is being provided as a courtesy to parties who are unable to attend. This bridge allows parties who are unable to attend to listen to the prehearing conference, but does not allow them to participate. It is not a substitute for participating in the conference. At this hearing, the Hearing Officer will establish the schedule for the rate case and rule on the draft Orders listed below. Please see the Federal Register Notice for more information about becoming a party to this proceeding. BPA expects to conclude the formal rate process in early October 2014 with the issuance of the Administrator’s Record of Decision.
