The Spill Surcharge was included in the BP-18 power rates to recover costs associated with the 2017 ruling by the U.S. District Court for the District of Oregon, which ordered increased spill at eight FCRPS dams on the lower Columbia and Snake rivers for the 2018 spring fish passage season.
Because the planned spill operations were not known when the final BP-18 rates were calculated, the Spill Surcharge adjusts power rates in each year of the rate period (FY 2018 and FY 2019) for the new planned spill operations relative to the operations modeled when final rates were set.
For each year of the rate period, the preliminary spill surcharge amount must be provided to customers no later than May 31, with a public meeting and a comment period of at least 10 business days to follow. Bonneville must issue the final Spill Surcharge no later than 14 calendar days after the comment period closes.
