Annual Notice of Right to Union Representation
Title 5 United State Code, Chapter 71 Section 7114(a)(3), dealing with federal labor-management relations, requires BPA to annually advise employees of their rights to union representation. These rights are known as Weingarten Rights.
In accordance with Section 7114(a)(2), the substance of the Weingarten Rights, an employee in a bargaining unit represented by an exclusively recognized labor organization has the right to request the presence of a union representative for any examination by a representative of the agency in connection with an investigation if the following criteria apply:
- The employee reasonably believes that the examination may result in disciplinary action against the employee.
- The employee requests representation.
As this notice of Weingarten Rights refers only to discipline, performance appraisal discussions are not considered investigative and are not covered.
